1.2 In these terms and conditions, Coastline Villa Holding B.V., i-Rent.net and MagicHomePhotos.com are referred to as “MagicHomePhotos”, “we”, “us” or “our”.

1.3 The person who uses the website, an account or the services is referred to as “the User” or “you”.

2. Applicability

2.1 These terms and conditions apply to every visit to MagicHomePhotos.com, every account, every purchase and every use of the service.

2.2 By creating an account, uploading photos, purchasing credits, starting an edit or otherwise using the service, you accept these terms and conditions.

2.3 If you use MagicHomePhotos on behalf of a company, rental organization, broker, photographer, property owner or other organization, you declare that you are authorized to legally bind that organization.

2.4 Deviations are only valid when MagicHomePhotos has confirmed them in writing.

2.5 Any general terms and conditions of the User are expressly rejected, unless MagicHomePhotos has accepted them in writing.

3. Definitions

3.1 “Service” means the website, software, image processing, AI functions, storage, download options, accounts, credits and related services of MagicHomePhotos.

3.2 “User Material” means all photos, images, texts, assignments, prompts, file names, metadata and other information uploaded or entered by the User.

3.3 “Result” means any image generated, improved, modified or reassembled by the Service.

3.4 “AI editing” means any automatic editing using artificial intelligence, machine learning, generative image technology or similar software.

3.5 “Consumer” means a natural person acting for purposes outside his trade, business or profession.

3.6 “Business User” means any person or organization using the Service in the context of a business, profession, rental activity, brokerage activity or other commercial activity.

3.7 “Credits” means the digital usage credit that a User can use to start image edits.

4. Purpose of the Service

4.1 MagicHomePhotos is exclusively intended for improving and professionally presenting photos of real estate.

4.2 The Service may only be used for photos of:

1. interiors of homes and other buildings
2. exteriors of homes and other buildings
3. gardens, terraces, swimming pools and outbuildings
4. properties offered for holiday rental
5. properties offered for normal rental
6. properties offered for sale
7. properties professionally photographed for an entitled client

4.3 The Service is not intended for portraits, personal photography, events, medical images, identity documents, surveillance footage, erotic images, or other types of imagery.

4.4 MagicHomePhotos does not provide structural inspections, appraisals, valuations, legal checks, safety checks, or real estate advice.

5. Age and Authority

5.1 You must be at least eighteen years old to create an account or use the Service.

5.2 Minors are not permitted to use the Service, not even with the consent of a parent or guardian.

5.3 You declare that all account information is complete and accurate.

5.4 You are responsible for all activities occurring through your account.

5.5 You must keep your password and other access credentials secret.

5.6 You must immediately report unauthorized use of your account to MagicHomePhotos.

6. Ownership and Rights to Uploaded Photos

6.1 You may only upload photos of which you are the owner or for which you possess all necessary rights of use and permissions.

6.2 You declare and guarantee that:

1. you have taken the photo yourself, or the copyright holder has given you sufficient permission
2. you are permitted to upload, copy, store, edit, and commercially use the photo
3. you are permitted to grant MagicHomePhotos permission to technically process the photo
4. the photo does not infringe any copyrights, portrait rights, privacy rights, trademark rights, property rights, or other third-party rights
5. the photo is not subject to a confidentiality obligation
6. the photo was not obtained unlawfully
7. the owner, tenant, resident, or manager of the photographed object has given permission when legally or contractually necessary

6.3 The fact that a photo is publicly available on the internet does not mean that you may upload or edit it.

6.4 Buying, renting, managing, or selling a property does not automatically grant you the copyright to photos taken by another photographer.

6.5 If a professional photographer has taken the photo, you must check whether the license also permits AI editing, commercial editing, reproduction, and publication.

6.6 MagicHomePhotos does not pre-check who the owner or rights holder of a photo is. You remain fully responsible for the rights to the User Material.

7. Prohibition of Photos with People

7.1 It is not permitted to upload photos in which a person is visible, recognizable, or identifiable.

7.2 This prohibition applies to, among others:

1. adults
2. children and other minors
3. faces and parts of faces
4. bodies and parts of bodies that could lead to identification
5. persons in mirrors, windows, and other reflective surfaces
6. persons visible on a television, computer screen, phone, or tablet
7. persons visible in photos, posters, or other images within the home
8. silhouettes where a person may be recognizable
9. persons visible through a window, door, or opening
10. license plates, nameplates, or other information by which a person can be indirectly identified

7.3 Photos with minors are always prohibited.

7.4 Even if a depicted person has given consent, the photo may not be uploaded. MagicHomePhotos has opted for a complete prohibition of photos with people.

7.5 You must carefully check each photo before uploading it.

7.6 Automatic detection may make mistakes. The absence of a block does not mean that MagicHomePhotos has approved the photo.

7.7 MagicHomePhotos may refuse, remove, or block a photo if a person may be visible on it.

7.8 If an edit is not performed because a photo contains persons, MagicHomePhotos may refund the credit used. MagicHomePhotos is not obliged to do so in case of repeated, deliberate, or serious misuse.

8. Privacy-sensitive information in property photos

8.1 You may not upload photos showing privacy-sensitive or confidential information.

8.2 Before uploading, you must, among other things, remove or make unreadable:

1. identity documents
2. passports and driving licenses
3. bank cards and credit cards
4. letters, invoices, and contracts
5. names, addresses, and telephone numbers
6. email addresses and reservation details
7. medical information
8. school records
9. photos of residents or family members
10. security codes and alarm systems
11. key locations and access codes
12. license plates
13. camera footage and security screens
14. wifi passwords
15. QR codes leading to personal information

8.3 You remain responsible if privacy-sensitive information remains visible due to carelessness, reflection, metadata, or another detail.

9. Other prohibited content

9.1 It is prohibited to upload material that is:

1. unlawful, punishable, or misleading
2. infringes copyrights or other third-party rights
3. threatens, insults, or discriminates against persons
4. contains sexual or pornographic content
5. shows or suggests child abuse or sexual exploitation
6. shows violence, torture, or serious injuries
7. promotes weapons, drugs, or other prohibited goods
8. contains malware, malicious code, or security risks
9. contains trade secrets or confidential documents
10. stolen, hacked, or obtained without permission
11. used for fraud, scams, or identity misuse
12. intended to falsify evidence or mislead an authority, insurer, buyer, or tenant

9.2 MagicHomePhotos may perform technical checks and automated security checks.

9.3 MagicHomePhotos is not obliged to manually check all uploads.

10. Responsible use of image enhancement

10.1 The Service is intended to improve the presentation quality of a real estate photo.

10.2 Permitted edits may include:

1. correction of light and color
2. improvement of brightness and contrast
3. correction of perspective and crop
4. reduction of digital noise
5. improvement of sharpness
6. tidying up loose, temporary, or distracting objects
7. improving the general presentation
8. limited virtual staging when applied clearly and honestly

10.3 You may not use the Service to create a materially inaccurate representation of the property.

10.4 You may not publish a Result if it gives an inaccurate or misleading impression of:

1. the size or dimensions of a space
2. the layout of the property
3. the number of rooms
4. the presence or size of windows and doors
5. the view
6. the distance to the sea, beach, facilities or other locations
7. the presence of a swimming pool, garden, parking space or terrace
8. the structural condition
9. moisture, mold, damage or other defects
10. safety features
11. furniture or equipment that is not present
12. air conditioning, heating or other installations
13. accessibility for persons with a disability
14. the current state of maintenance
15. the surroundings of the property
16. characteristics that may influence the decision of a buyer or tenant

10.5 You may not conceal permanent damage, serious defects, safety risks or structural problems.

10.6 You may not add facilities that are not actually present, unless it is clearly stated that it is an atmospheric impression, concept rendering or virtual furnishing.

10.7 When furniture, decoration or other elements have been digitally added, you must clearly state this when it may be relevant for a buyer or tenant.

10.8 You must always compare the Result with the original photo and with the current situation of the property.

10.9 You must keep the original unedited photo.

10.10 The publication of a Result always remains an independent decision of the User.

11. Responsibility for real estate advertisements

11.1 You are fully responsible for the accuracy of every advertisement, property presentation, sales brochure, booking page and other publication in which a Result is used.

11.2 You must check whether the publication complies with:

1. applicable consumer legislation
2. rules against misleading commercial practices
3. real estate legislation
4. rental legislation
5. rules of tourist authorities
6. rules of advertising platforms
7. professional rules applicable to real estate agents or other professionals

11.3 MagicHomePhotos does not guarantee that a Result will be accepted by Booking.com, Airbnb, Vrbo, Google, Meta, a real estate platform, an advertising platform or any other third party.

11.4 MagicHomePhotos is not a party to any agreement between the User and an owner, tenant, guest, buyer, seller, photographer, real estate agent or advertising platform.

11.5 You must state every material AI modification when required by law, a platform or the circumstances.

11.6 You may not remove or hide legally required metadata, markings or indications of AI editing.

12. Operation of artificial intelligence

12.1 The Service uses automated technology and may use systems from external AI suppliers.

12.2 AI systems can produce unexpected, inaccurate or undesirable results.

12.3 A Result may include:

1. misinterpret details
2. add, change or remove objects
3. incorrectly display colors or materials
4. adjust shapes and proportions
5. distort text, logos or patterns
6. unintentionally change parts of a property
7. reduce or enhance visible defects
8. produce an image that is not suitable for publication

12.4 MagicHomePhotos does not guarantee that every Result is error-free, complete, unique or suitable for a specific purpose.

12.5 You must assess every Result yourself before downloading, using, sharing or publishing it.

12.6 A generated Result does not confirm that the uploaded photo is lawful.

12.7 Successful processing does not mean that MagicHomePhotos has approved the content, quality or accuracy.

13. User commands and prompts

13.1 You can enter additional instructions with a photo.

13.2 You are responsible for the content and consequences of these instructions.

13.3 You may not issue a command that violates the law or these terms.

13.4 You may not instruct the Service to:

1. add people
2. alter existing people
3. create or replace faces
4. falsify documents or evidence
5. create illegal content
6. intentionally misrepresent a property
7. remove security features when this causes risks
8. reproduce copyrighted material without permission

13.5 MagicHomePhotos may refuse or automatically adjust commands if they are potentially unsafe, unlawful or technically unsuitable.

14. Rights to User Material

14.1 You retain the rights you have to the User Material.

14.2 By uploading User Material, you grant MagicHomePhotos a limited, non-exclusive, worldwide and royalty-free license to the material to:

1. receive
2. temporarily store
3. technically copy
4. analyze
5. offer to AI systems
6. edit
7. make available to you as a Result
8. secure
9. monitor for abuse
10. store when legally required

14.3 MagicHomePhotos may transfer this limited license to hosting companies, AI suppliers and other technical service providers insofar as this is necessary to perform the Service.

14.4 The license ends when the material is no longer needed for the Service, subject to legal retention obligations, security copies and justified retention in case of disputes or abuse.

14.5 MagicHomePhotos does not use User Material for general training of its own or external AI models, unless you have given separate and express consent thereto.

14.6 MagicHomePhotos does not sell your uploaded photos as stock photos and does not provide them to third parties for independent commercial publication.

15. Rights to Results

15.1 To the extent legally possible, you may use the Result for the purpose for which you procured the Service.

15.2 Insofar as MagicHomePhotos acquires rights to a Result, MagicHomePhotos grants you a worldwide, transferable and commercial use license for that Result.

15.3 MagicHomePhotos does not guarantee that a Result is protected by copyright in every country.

15.4 MagicHomePhotos does not guarantee that you can acquire exclusive rights to a Result.

15.5 Due to the nature of AI technology, other users may receive similar Results.

15.6 Your right to use a Result depends on your rights to the original photo and other components of the User Material.

15.7 If the original photo or other content infringes third party rights, this infringement is not resolved by having the photo edited with AI.

16. Accounts

16.1 Each User may only create accounts for lawful use.

16.2 It is forbidden to:

1. use a false identity
2. use accounts belonging to others
3. create multiple accounts to circumvent free usage limits
4. sell or share access data
5. circumvent security measures
6. send large numbers of automated requests without permission
7. copy, reverse-engineer, or technically examine the Service, except where mandatory law permits this
8. use the Service to train a competing AI model or similar service

16.3 MagicHomePhotos may set reasonable usage limits to protect the security and availability of the Service.

17. Free use and promotions

17.1 MagicHomePhotos may offer free photos, trial credits, discounts, or other promotions.

17.2 A promotion is only valid under the conditions stated with the promotion.

17.3 Free use is personal and may not be repeated through multiple accounts.

17.4 Free credits have no monetary value and cannot be paid out.

17.5 MagicHomePhotos may change or terminate a promotion. This does not affect legal rights already acquired.

17.6 MagicHomePhotos may revoke free credits in cases of fraud, abuse, or violation of these terms.

18. Prices, credits, and payments

18.1 The current prices are shown on the website or during the purchase process.

18.2 For payment, it will be clearly indicated whether prices include or exclude VAT.

18.3 Business Users must provide correct company and VAT details.

18.4 Payments may be processed by Stripe or another external payment service provider.

18.5 The terms and privacy rules of the payment service provider may additionally apply.

18.6 Credits:

1. are linked to the account for which they were purchased
2. may not be sold without permission
3. cannot be used outside MagicHomePhotos
4. cannot be exchanged for cash
5. may only expire when this has been clearly stated in advance and is legally permitted

18.7 A credit is normally consumed when image processing is initiated.

18.8 If processing completely fails due to a technical error on the part of MagicHomePhotos, MagicHomePhotos may automatically return the credit or re-execute the processing.

18.9 A result that does not meet personal taste or preference does not automatically entitle to a refund.

18.10 Statutory rights in case of a defective or non-conforming digital service remain fully applicable.

18.11 You may not reverse a payment without a valid reason.

18.12 In the event of an unjustified chargeback, MagicHomePhotos may temporarily block the account and charge reasonable collection costs to the extent permitted by law.

19. Right of withdrawal for consumers

19.1 A Consumer may, in principle, have a statutory right of withdrawal for an online agreement.

19.2 The statutory withdrawal period is normally fourteen days from the conclusion of the agreement.

19.3 When you request the digital Service to be performed immediately, the performance may begin during the withdrawal period.

19.4 Before a paid editing process is started immediately, MagicHomePhotos may ask you to explicitly confirm that:

1. you request immediate performance of the Service
2. you understand that performance begins immediately
3. you understand that your right of withdrawal may lapse after the digital content has been fully delivered
4. in the event of a partially performed service, you may have to pay for the part already performed, to the extent permitted by law

19.5 Where the law requires the right of withdrawal to be maintained, this provision shall be applied in accordance with that law.

19.6 A request for withdrawal can be sent to notify@i-rent.net, stating your name, account address, purchase date and transaction number.

19.7 This provision does not limit other legal consumer rights.

20. Quality and conformity of the Service

20.1 MagicHomePhotos provides the Service in accordance with the description provided during the order or on the website.

20.2 If a paid processing completely fails or clearly does not correspond to the agreed functionality, you must report this within a reasonable period.

20.3 MagicHomePhotos may, depending on the problem:

1. re-process the order
2. return a credit
3. fix a technical problem
4. refund a proportionate amount
5. offer another legally required solution

20.4 MagicHomePhotos must first be given a reasonable opportunity to investigate and rectify the problem.

20.5 You must provide sufficient information to investigate the problem.

20.6 Problems arising from an unsuitable source photo, prohibited content, incorrect instructions, poor internet connection or use outside the purpose of the Service do not automatically constitute a defect in the Service.

21. Storage and deletion

21.1 MagicHomePhotos may temporarily store original photos and Results to provide the Service.

21.2 The current retention periods are described in the Privacy Policy or in the account.

21.3 You must keep copies of original photos and Results yourself.

21.4 MagicHomePhotos is not a permanent archiving service or backup service.

21.5 MagicHomePhotos may delete material:

1. after the expiry of a retention period
2. after deletion of the account
3. in case of violation of these terms and conditions
4. for security reasons
5. after a valid legal notification
6. when storage is no longer necessary

21.6 Deleted files may still temporarily be present in security copies.

21.7 MagicHomePhotos may retain information longer when this is necessary for a legal obligation, fraud prevention, security investigation or legal dispute.

22. Personal data

22.1 MagicHomePhotos processes personal data in accordance with the General Data Protection Regulation and applicable national privacy legislation.

22.2 The processing of account data, payment data, communication data and technical data is described in the Privacy Policy.

22.3 When a Business User has personal data processed through the Service, the Business User can act as controller and MagicHomePhotos as processor.

22.4 When legally required, parties can conclude a data processing agreement.

22.5 MagicHomePhotos may engage sub-processors for hosting, security, payment, support and AI processing.

22.6 Transfer of personal data outside the European Economic Area only takes place on the basis of a legally permitted transfer mechanism.

22.7 The prohibition on photos with individuals remains in effect, even when a processor agreement has been concluded.

22.8 You must report data breaches or inadvertently uploaded personal data immediately via notify@i-rent.net.

23. External service providers

23.1 MagicHomePhotos may use external service providers for:

1. cloud hosting
2. storage
3. AI processing
4. payments
5. email
6. security
7. analysis
8. customer service

23.2 MagicHomePhotos selects service providers based on reasonable technical, legal, and security requirements.

23.3 External systems may be temporarily unavailable or change their functionality.

23.4 MagicHomePhotos is not responsible for external websites or services unrelated to the Service.

24. Availability and changes

24.1 MagicHomePhotos strives to keep the Service available in a reliable and secure manner.

24.2 MagicHomePhotos does not guarantee uninterrupted availability.

24.3 The Service may be temporarily interrupted by:

1. maintenance
2. updates
3. security incidents
4. malfunctions at external suppliers
5. internet problems
6. force majeure
7. legal measures

24.4 MagicHomePhotos may modify, replace, or terminate functions.

24.5 In the event of a material change to an ongoing paid service, MagicHomePhotos will inform the User in advance when reasonably possible and legally required.

24.6 A Consumer may terminate an ongoing agreement when a material change negatively affects their use and the law grants them this right.

25. Security

25.1 You may not test the security of the Service without prior written consent.

25.2 It is prohibited to:

1. gain unauthorized access
2. exploit vulnerabilities
3. upload malware
4. cause large volumes of traffic with the aim of disrupting the Service
5. circumvent technical limits
6. collect data from other users

25.3 Security issues can be reported via notify@i-rent.net.

25.4 You must take reasonable measures to protect your account and devices.

26. Control, blocking, and removal

26.1 MagicHomePhotos may automatically or manually review User Material when necessary for safety, support, fraud prevention, or compliance with the law.

26.2 MagicHomePhotos may refuse, block, or remove content when:

1. these terms are violated
2. third-party rights may be infringed
3. personal data or identifiable persons may be involved
4. the content may be unlawful
5. the Service or other users are at risk
6. a competent authority requests removal

26.3 MagicHomePhotos may temporarily block an account during an investigation.

26.4 In case of serious or repeated violations, MagicHomePhotos may terminate the account.

26.5 MagicHomePhotos may retain relevant data when necessary for investigation, evidence, or compliance with the law.

26.6 A User can object to a blocking via notify@i-rent.net.

27. Notifications of third-party rights

27.1 A rights holder can report alleged unlawful material via notify@i-rent.net.

27.2 The notification must contain as much as possible:

1. the name and contact details of the reporter
2. a description of the protected right
3. a clear identification of the material concerned
4. the reason why the use is unlawful
5. proof of ownership or representation
6. a statement that the information has been provided truthfully

27.3 MagicHomePhotos may temporarily block the material concerned during the investigation.

27.4 MagicHomePhotos may request a response or proof of consent from the User.

27.5 MagicHomePhotos may provide data when legally obliged to do so or ordered by a competent authority.

28. User's Liability

28.1 You are responsible for:

1. the User Material
2. your assignments
3. your right to upload photos
4. the control of Results
5. the publication of Results
6. the accuracy of housing advertisements
7. compliance with legislation and platform rules
8. claims from owners, photographers, residents, tenants, buyers, guests and other third parties arising from your actions

28.2 You are responsible for damage resulting from you:

1. uploading a photo without sufficient rights
2. uploading a photo with people
3. uploading privacy-sensitive information
4. publishing a misleading housing photo
5. using a Result without verification
6. omitting a legally required mention
7. using the Service for a prohibited purpose

28.3 Business Users indemnify MagicHomePhotos against reasonable claims, damages and costs of third parties directly arising from a breach of these terms.

28.4 The indemnification in article 28.3 only applies to the extent permitted by applicable law.

28.5 For Consumers, no broader liability applies than is permitted by mandatory consumer law.

29. Liability of MagicHomePhotos

29.1 MagicHomePhotos is responsible for damage when and insofar as this is mandatory under mandatory law.

29.2 Nothing in these terms excludes liability for:

1. intent or wilful recklessness of MagicHomePhotos
2. death or bodily injury for which exclusion is not legally permitted
3. fraud
4. violation of statutory consumer rights that cannot be excluded
5. other liability that cannot be limited by law

29.3 MagicHomePhotos is not responsible for damage arising from:

1. unlawful User Material
2. missing rights or permissions
3. publication without verification
4. misleading presentation of a property
5. decisions of buyers, tenants, guests, owners or advertising platforms
6. loss of original files if the User has not made a backup
7. improper use of the Service
8. use contrary to instructions or these terms
9. changes made by the User after downloading

29.4 For Business Users, MagicHomePhotos is not liable for indirect damage, consequential damage, loss of profit, missed bookings, lost sales, loss of reputation, loss of data or claims from the Business User's customers.

29.5 The total liability of MagicHomePhotos towards a Business User is limited to the amount that this User has paid to MagicHomePhotos in the twelve months prior to the damage-causing event.

29.6 When multiple events have the same cause, they are considered a single event.

29.7 The limitations in this article only apply to the extent permitted by applicable law.

29.8 For Consumers, liability limitations are only applied insofar as they are fair, clear and legally valid.

30. Force Majeure

30.1 MagicHomePhotos is not responsible for delay or failure due to circumstances reasonably beyond its control.

30.2 This includes, but is not limited to:

1. power outages
2. internet disruptions
3. cyber attacks
4. disruptions at cloud or AI providers
5. natural disasters
6. war or terrorism
7. strikes
8. government measures
9. pandemics
10. serious technical incidents

30.3 MagicHomePhotos will reasonably attempt to mitigate the consequences of force majeure.

31. Term and termination

31.1 The agreement begins when you accept the terms or use the Service.

31.2 You can terminate your account via the account or by contacting customer service.

31.3 Termination does not automatically entitle you to a refund of used credits.

31.4 Unused paid credits will be treated according to the purchase terms and applicable consumer law.

31.5 MagicHomePhotos may terminate the account when:

1. you seriously or repeatedly violate these terms
2. you upload unlawful content
3. you commit fraud
4. you unlawfully charge back payments
5. your use causes a security risk
6. MagicHomePhotos is legally obliged to terminate the account

31.6 Where remediation is possible, MagicHomePhotos may first give the User a reasonable period to remedy a violation.

31.7 In case of serious security risks, illegal content, or fraud, MagicHomePhotos may act immediately.

31.8 Provisions regarding rights, liability, payments, disputes and other subjects which by their nature are intended to continue shall remain in effect after termination.

32. Complaints

32.1 Complaints can be sent to notify@i-rent.net.

32.2 When submitting a complaint, please include:

1. your name
2. the email address of your account
3. the date of processing or purchase
4. the transaction number
5. a clear description of the problem
6. the desired outcome

32.3 MagicHomePhotos will confirm receipt of a complaint within a reasonable period.

32.4 MagicHomePhotos will endeavor to respond substantively to complaints within fourteen days. If more time is needed, you will be notified.

32.5 Consumers retain the right to use competent consumer authorities and out-of-court dispute resolution procedures available by law.

33. Applicable law

33.1 These terms and the agreement are governed by Dutch law.

33.2 This choice of law does not deprive a Consumer of the protection afforded by mandatory provisions of the country in which the Consumer habitually resides, where such protection applies under European or national law.

33.3 For Users residing in Spain, mandatory Spanish rules on consumer protection, privacy, image rights, intellectual property, and electronic services remain applicable when required by law.

33.4 The Vienna Sales Convention does not apply.

34. Competent court

34.1 Disputes with a Business User will be submitted to the competent court in the district where MagicHomePhotos has its registered office, unless mandatory law dictates otherwise.

34.2 A Consumer may submit a dispute to the court competent under the applicable European and national rules.

34.3 MagicHomePhotos will only summon a Consumer before a court when permitted by mandatory rules on consumer jurisdiction.

34.4 Parties shall first attempt to resolve a dispute through amicable consultation.

35. Amendment of these terms and conditions

35.1 MagicHomePhotos may amend these terms and conditions.

35.2 The new version will be published on the website with a new version date.

35.3 Material changes to an ongoing paid agreement will be notified in advance when legally required.

35.4 Changes may take effect immediately when necessary due to:

1. a change in law
2. a court decision
3. a directive from a supervisory authority
4. an urgent security issue
5. the cessation of abuse

35.5 For a separate paid image processing, the terms and conditions accepted at the start of that processing apply.

35.6 A Consumer may terminate an ongoing agreement if an adverse change grants them this right under the law.

36. Transfer

36.1 A Consumer may exercise and transfer their legal rights when permitted by law.

36.2 A Business User may not transfer their agreement without the written consent of MagicHomePhotos.

36.3 MagicHomePhotos may transfer the agreement to an affiliated company or legal successor, provided that the rights of Consumers are not diminished thereby.

37. Severability

37.1 If a provision is found to be invalid or unenforceable, the remaining provisions shall remain valid.

37.2 The invalid provision will be replaced by a valid provision that approximates the purpose of the original provision as closely as possible.

37.3 For Consumers, the interpretation required by mandatory consumer law shall always apply.

38. No waiver of rights

38.1 If MagicHomePhotos does not immediately exercise a right, this does not mean that MagicHomePhotos waives that right.

38.2 A one-time exception does not grant a right to an exception in a subsequent situation.

39. Entire Agreement

39.1 These terms and conditions, the Privacy Policy, the Cookie Policy, any processor agreement, and the information displayed during the order collectively form the agreement.

39.2 In case of contradiction, the individually agreed arrangement shall apply first, then the purchase information, and then these general terms and conditions.

39.3 Mandatory law always takes precedence.

40. Language

40.1 MagicHomePhotos may offer these terms and conditions in multiple languages.

40.2 For Consumers, the language version clearly shown to them and accepted by them at the conclusion of the agreement shall apply.

40.3 For Business Users, in case of discrepancies between translations, the Dutch version shall apply, unless otherwise agreed in writing.

40.4 A translation may never be used to limit legal consumer rights.

APPENDIX 1. Mandatory confirmations upon upload

Before a User can have a photo processed, the User must actively confirm:

1. I confirm that I own this photo or have sufficient permission to upload the photo, have it edited, and use it commercially.
2. I confirm that no persons are visible or identifiable in this photo, not even in mirrors, windows, screens, photos, or reflections.
3. I confirm that the photo does not contain personal documents, license plates, access codes, or other privacy-sensitive information.
4. I understand that AI may unexpectedly modify parts of the photo and that I must review the Result myself.
5. I will not use the Result to mislead buyers, tenants, guests, owners, or other persons.
6. I understand that I am responsible for the publication and use of the Result.

APPENDIX 2. Additional confirmation for direct paid processing by consumers

I request MagicHomePhotos to commence performance immediately during the statutory withdrawal period. I understand that my right of withdrawal may lapse after the digital content has been fully delivered, to the extent permitted by applicable law.
